Terms of Service
Effective date: October 10, 2026
Operator: DJ Creative Design Inc. (“HoopKeeper”, “we”, “us”), Toronto, Ontario, Canada. Contact: legal@hoopkeeper.com.
1. What these Terms cover
These Terms govern your use of hoopkeeper.com, the HoopKeeper demo and test drive, and any league website we host and operate for you (a “League Site”) under a HoopKeeper subscription (together, the “Service”). By creating an account, starting a test drive, or paying for a subscription, you agree to these Terms. If you are acting for a league, club or organization, you confirm you have authority to bind it, and “you” means that organization.
You must be at least 18 years old to subscribe. League Sites may publish information about players under 18; see section 7.
2. The Service
HoopKeeper provides a hosted basketball league management platform: a WordPress-based League Site set up for you on our infrastructure (currently a separate install per league on a subdomain such as yourleague.hoopkeeper.app, or a domain you own), the CourtSide League software, team registration and payments, schedules, standings, statistics, player and team pages, email notifications, and an AI help chat for league staff.
We may change, add or remove features. We will give reasonable notice of changes that materially reduce the Service.
3. Plans, pricing and billing
- Subscriptions are sold in Canadian dollars through our payment provider (currently SureCart, with card processing by Stripe). Plans are Starter, League and Pro, billed monthly or yearly at the prices shown at hoopkeeper.com/pricing. Taxes (HST/GST/PST) are added where applicable.
- Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current period. We do not prorate or refund partial periods except where required by law.
- If a payment fails, we will notify you and retry. If payment is not received within 7 days, we may suspend the League Site (it stays online read-only or shows a notice) and, after 30 days, close it and delete its data in line with section 9.
- We may change prices with at least 30 days' notice by email. Price changes apply at your next renewal.
- The free test drive runs on our shared demo league and needs no card. It does not create a League Site or a subscription.
4. Payments you collect through your League Site
Team fees, deposits, day passes and other charges that your league collects run through your own payment account (for example your SureCart store and Stripe or PayPal account), not ours. You are the merchant of record for those payments. You set your own prices, refund policy and taxes, and you are responsible for refunds, chargebacks and disputes with your participants. HoopKeeper does not hold your funds.
5. Your account and your responsibilities
You are responsible for:
- keeping sign-in credentials confidential, and for everything done under your account and by staff you invite;
- the accuracy and legality of content you publish (team names, logos, photos, rosters, scores, rules, streaming footage);
- getting the permissions you need before publishing information about people, especially minors (see section 7 and our Privacy Policy);
- complying with laws that apply to your league, including privacy, consumer protection and tax law in your province or state;
- the conduct of your coaches, players and visitors on your League Site.
6. Acceptable use
You will not use the Service to: break the law; publish content that is defamatory, harassing, hateful, obscene or infringes someone's rights; upload malware; attempt to access other customers' League Sites or our systems; resell or sublicense the Service; or use it for anything other than running a sports league or organization. We may remove content or suspend access that violates this section, after notice where practical.
7. Players, minors and consent
League Sites commonly show player names, photos, jersey numbers, statistics and team affiliation, and may stream or record games. Before entering a player into your League Site you must have the player's consent, and for a player under the age of majority in your province or state, the consent of a parent or guardian. HoopKeeper provides a registration form and consent wording you can adapt, but you are responsible for obtaining and keeping those consents and for honouring a request to remove a player's information. We will act on your instructions to remove or anonymize a player promptly.
8. Your data and ours
- Your content (league data, rosters, media, participant information) belongs to you or your participants. You grant us a licence to host, copy, back up, display and process it only as needed to provide and support the Service.
- Our platform (HoopKeeper, CourtSide League, Control, designs, templates and documentation) belongs to DJ Creative Design Inc. and its licensors. Third-party components such as WordPress, Elementor, JetEngine and SureCart are provided under their own licences, which we hold for hosted League Sites.
- We may use aggregated, de-identified usage data (for example how many leagues use a feature) to improve the Service.
- We act as a service provider / processor for personal information on your League Site and as the controller for hoopkeeper.com account and billing data. Our Privacy Policy describes this in detail.
9. Export, cancellation and deletion
You can export your league data (teams, players, games, standings) at any time in CSV form from the League admin. After cancellation or termination we keep your League Site data for 30 days so you can export it, then delete it from live systems; backups roll off within a further 90 days.
10. AI help chat
The help chat available to league staff sends your questions, and relevant context from your League Site, to our HQ server and on to Anthropic's Claude API to generate an answer. Problems you report may be turned into support tickets. Do not paste passwords or participants' sensitive personal information into the chat. Answers may be wrong; check anything important. Anthropic's API terms state that API inputs and outputs are not used to train its models.
11. Uptime, support and backups
We aim to keep League Sites available at all times but do not guarantee uninterrupted service. We take regular backups and will restore from them if we lose data. Support is by email at support@hoopkeeper.com and through the in-app help chat, during Eastern time business hours. Response targets, if any, are per plan on the pricing page.
12. Third-party services
The Service depends on third parties, including our hosting provider (Hostinger), payment providers (SureCart, Stripe), email delivery, GitHub (for software updates and issue tracking) and Anthropic (AI help chat). We are not responsible for their outages or acts, but we choose and monitor them with care.
13. Warranties and liability
The Service is provided “as is”. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profits, data or goodwill. Our total liability for any claim in a 12-month period is limited to the fees you paid us in that period. Nothing in these Terms limits liability that cannot be limited under applicable law, including under Ontario's Consumer Protection Act where it applies.
14. Indemnity
You will defend and indemnify us against third-party claims arising from content you publish, participant information you collect without proper consent, payments you collect, or your breach of these Terms.
15. Termination
You may cancel at any time. We may suspend or terminate the Service for non-payment, breach of these Terms, legal requirement, or if we discontinue the Service (with at least 60 days' notice and a data export window). Sections 4, 8, 9, 13, 14 and 17 survive termination.
16. Changes to these Terms
We may update these Terms. For material changes we will email account holders at least 30 days in advance. Continuing to use the Service after the effective date means you accept the new Terms.
17. Governing law
These Terms are governed by the laws of Ontario and the federal laws of Canada applicable there. Disputes will be heard in the courts of Ontario, Toronto. If any part of these Terms is unenforceable, the rest remains in effect. These Terms, the Privacy Policy and your plan order form are the whole agreement between us.
